1. ABOUT SKIPPA AND THIS POLICY

SKIPPA is a Product of LINQ LIMITED trading as “LINQ” (a limited liability company incorporated in Nigeria under the Companies and Allied Matters Act (CAMA), with RC No. RC1956079) (hereinafter referred to as “LINQ” or “we”). SKIPPA is a software, platform and/or app created by LINQ which links Delivery/Logistics Companies and Service Providers (including individual dispatch riders) to prospective Customers who are interested in engaging their services and vice versa. In other words, the SKIPPA platform is one of such created to act as a middleman between Delivery/Logistic Companies and Services Providers (on one hand) and interested Customers (on the other hand).

For the purpose of the operation of SKIPPA and its overall functionality, LINQ shall be responsible for accessing, receiving and processing your personal data. Should you have any questions or concerns relating to this privacy policy or your personal data, you can contact us via the contact details subsequently provided below.

These several personal data obtained by LINQ, are received and processed in the course of the installation and use of the SKIPPA app. They are also collected and processed during registration and on-boarding on the app, and also in the course of registered services providers and companies rendering their services. The collection and processing of personal data is done in accordance with the relevant terms of use. It is important to state that the processing of geographical location data is generally necessary for effective use and operation of the SKIPPA Platform.

LINQ may also collect personal data about Clients/Customers that interact with us through several other means as the occasion may warrant. By using our websites, apps and services, you acknowledge and consent that we process your personal data in accordance with this privacy policy.

2. WHAT TYPE OF CLIENT PERSONAL DATA DO WE COLLECT AND PROCESS?

To ensure the effective operation of SKIPPA and to enable us adequately discharge and render our contractual obligation and services to you, our Client(s), whether service provider or consumer, LINQ collects and processes your personal data. These data include:

i. biographical and contact information including name, telephone number, e-mail address, incorporation/registration number (Companies and registered Businesses) as collected during installation of the app;

ii. information related to Order(s) and delivery requests made via SKIPPA app including information on consumer's preferences, etc.;

iii. geographic location from where the app is accessed and used and the destination where the order or delivery is to be made;

iv. where you register for an account, your user ID and password and associated account information such as your preferences and any applicable promo codes;

v. where you choose to connect to the service from a third party service, such as Google, Twitter, Facebook, your information from that service as may be necessary;

vi. feedback ratings (including information provided to resolve disputes);

vii. payment information and payment history;

viii. information regarding your delivery requests/order (when you are the Client) or of your acceptance to deliver (when you are the Courier delivery service provider or Company). These information may include geographical location, the time service was rendered or concluded, details of the route of delivery and destination, price paid and other order history;

ix. text, images and other personal details you provide;

x. where we ban or suspend you from using SKIPPA and its related services, a record of that ban suspension;

xi. identification data of the device on which you installed the SKIPPA app;

xii. website and communication information such as details collected by cookies and other similar tracking technologies when you use our sites or apps;

xiii. details of support queries you make (e.g. through our app or via other communication channels), including record of any reported lost items; and

xiv. where we reasonably suspect fraud, details of offences or alleged offences from fraud detection and prevention agencies.

3. OUR DATA PROTECTION PRINCIPLES

In line with our data protection practice and responsiveness, we assure you of our utmost commitment in ensuring that your personal data is only processed in accordance with and for only lawful purposes, as consented to by you. LINQ commits itself to ensuring that your personal information are stored only for the period within which it is reasonably needed and are, at all times, duly secured against reasonably foreseeable hazards and breaches such as theft, cyber attack, unauthorized dissemination and manipulations of any kind.

4. CLIENT PERSONAL DATA RETENTION

LINQ will retain your personal data for as long as it is reasonably necessary and needed to achieve the various purposes set out in this Privacy Policy which includes rendering Services to you through the SKIPPA platform and/or app. This period of time will include but is not limited to the period during which your SKIPPA account is active and functional. We will also retain and use your personal data as may be necessary to: comply with our several legal obligations under extant legislations and statutes, resolve disputes and enforce our agreements with you, the Client. In the event of a request for account deletion, we will, notwithstanding the deletion of your account, save your email address, phone number and identification documents.

5. WHY DO WE PROCESS YOUR PERSONAL DATA?

We process your personal data for the following purpose:

i. To adequately provide our Service to Clients: LINQ processes your personal data to ensure that you enjoy our services on the SKIPPA app seamlessly and without avoidable errors or technical glitches.

ii. To give you a pleasant Customized Experience: We process your personal data to ensure that we adjust and tailor our services to your taste while affording you a most pleasant experience on our app based preferences and interests.

iii. To manage your account and provide necessary customer support: Your personal data is processed to ensure that we duly manage your account and also, promptly respond to and resolve your requests for technical support, service information or any other such communication as you may require. This may require us sending you notifications or emails, where necessary, regarding the performance of our Service, security, payment transactions, notices regarding our Terms of Use or this Privacy Policy.

iv. To enable further research and continuous improvements: Processing your data enables and helps us to: have a better understanding of the impact of our service on/to you while also continuously analyzing our operations with a bid to maintaining, improving, upgrading and enhancing SKIPPA and other subsequent products of ours, to serve you better. Through this, we have a better understanding of what features Clients prefer more and what features need to be modified.

v. To communicate with you using our service and app: It is necessary that we maintain a free flow of communication with you regarding your use of the SKIPPA app and the accompanying services. These communications may come as push notifications, personalized chats or even as emails. In the course of these communications, certain personal data may be collected concerning the date and time when the message was viewed by the Client or User as well as when they interacted with it, such as by clicking on links included in the message.

vi. To personalize Advertisements: We and our marketing/advertising partners use your personal data to tailor and adjust advertisements relevant to you. These advertisements may come up on your respective social media feeds.

vii. To send you Marketing Communications: We use and process your personal data for the purpose of our marketing campaigns. Your email address may be added to our marketing list as a result of which you may receive information and details on new services and products including special offers and discounts.

6. WITH WHOM DO WE SHARE YOUR PERSONAL DATA?

In the course of rendering our services and necessary functions on SKIPPA and in a bid to ensuring that you, our esteemed Client enjoys the best and most satisfying services, LINQ may be required to share your personal information with third parties who help and work with us in the course of running, providing, integrating, customizing, upgrading, and advertising our Service. The classes of third parties we share information include but is not limited to:

i. Service Providers: in the course of your use and subscription to the SKIPPA app, we may be required to share your personal data with third parties engaged by LINQ to render and provide one key service or the other, on our behalf and based on our instructions. These service providers may range from: Cloud Storage Providers such as Amazon and/or Hetzner to Data Analytics Providers like Facebook and/or Google then to Login Service Providers like Google, Apple, Facebook and even True-caller and finally, to Marketing/Advertising Partners (including social media networks, marketing agencies and email delivery services). We may also share your personal data to Payment Services Providers including local banks and other relevant financial institutions.

ii. Courts, Law Enforcement Agencies And Other Public Authorities: we may disclose personal data in furtherance of the Order of a Competent Court of law or pursuant to and in response to a formal request from law enforcement agencies, regulatory agencies, and other public and government authorities or as may be required by any law or statute.

iii. Third Parties in the event of a Merger/Outright Sale/ Corporate Restructuring: in the event of a merger, buy out, consolidation or any other such form of corporate restructuring, we may be required to disclose to our third party partners or affiliates, certain personal data of yours especially in view of the fact that Clients’ data and information generally happens to be one of the several business assets transferred in the course of transactions as this. We may also share such information with any such appointed receiver or manager in the event of a case of Bankruptcy.

7. DISCLOSURE OF PERSONAL DATA AS BETWEEN CLIENTS (DISPATCH/ LOGISTICS COMPANY & SERVICE PROVIDERS, ON ONE HAND, AND CUSTOMERS, ON THE OTHER HAND)

The personal data of registered Couriers/Dispatch/Logistics Companies and service providers (“Service Providers”) is disclosed to Customers once the Service Provider has accepted the request for delivery service and the contract for delivery service is concluded with a designated dispatch rider or person assigned to the delivery request. Customers will see the name and geographic location of the designated dispatch person. At the same time, the personal data of the Customer will be disclosed to the Service Provider and the Dispatch person/rider with whom the Customer concludes the contract for delivery service. Pursuant to a data processing agreement concluded between the Service provider and LINQ, the service Provider may be required to retain all of Customer’s Data in relation to the Delivery service rendered, for as long as may be agreed between parties. Please note that the personal data of Customers may be disclosed to Service Providers and vice versa as may be necessary under and in accordance with 6(ii) of this Privacy Policy.

8. REMEDIES AVAILABLE TO CLIENTS IN THE EVENT OF BREACH

In the event of a Data Breach, we shall take all possible steps to inform you of such breach and the level of risk imposed by such breach. We shall also do well to notify all concerned supervisory agencies especially where prescribed by statutes or any extent applicable Law. Notwithstanding the notification of Clients on the Data Breach, we shall do well to employ all measures possible in ensuring that the said breach is immediately contained and resolved. The time frame for notification shall be determined based on the number of persons or entities affected by the data breach and the time needed to access the necessary contact information for such notification(s).

Where Client is not satisfied by the measures employed by LINQ, you shall give notice of such dissatisfaction and where same remains unaddressed within a period of four (4) weeks from the “Expression of Dissatisfaction”, you may file a complaint at/to the relevant supervisory authority or seek redress in Court.

9. HOW YOU CAN EXERCISE YOUR RIGHTS?

In respect of your personal data received by us and on behalf of us, you have the following rights:

i. Right to Access, Review, Update and Correct Your Personal Data: You may review and update personal data you had previously provided to LINQ on SKIPPA. This you may do on the “Edit Profile” section of the App/Platform.

ii. Right to Request Deletion: You have a right to request the deletion of your personal data collected during your use of the Service. You can request a deletion of your personal data by sending us an email at Support@skippabylinq.com or you can delete your account via the SKIPPA app. When you request a deletion of your personal data, we will employ all reasonable measures to ensure that your personal data is deleted within reasonable time. Where we are under a legal obligation to keep any of your personal data for a period of time, we will fulfill your request only after we have complied with the said obligation(s) on us.

iii. Right to Object or Restrict the Use of Personal Data: Clients may object to the use of their personal data or restrict the use of the same by LINQ for some purposes as specified in this Privacy Policy. This request may be made to us via our contact email address at: Support@skippabylinq.com

iv. Right to Seek Redress in the event of a Breach of this Policy: We recognize your right to seek redress where necessary and would not interfere with the same. However, you are under an obligation to notify us promptly of whatever observations, concerns or dissatisfaction you may have regarding our services.

10. MODIFICATIONS AND ALTERATIONS

We reserve the right to modify this Privacy Policy from time to time as is necessary and in line with international best practices. In the event of a review or modification to this Privacy Policy, you shall be notified via the app or through the email address you provided to us at the time of your registration or by other available means possible. You will be afforded the opportunity of reviewing the revised Privacy Policy and either agreeing to the same or rejecting it. By continuing to access or use the Service after those changes become effective, you agree to be bound by the revised Privacy Policy.
